STRAIGHT GAS – TERMS OF SALE, ARBITRATION AGREEMENT, RISK DISCLOSURE & LEGAL NOTICE

IMPORTANT – LEGAL AGREEMENT

THIS DOCUMENT CONTAINS A BINDING ARBITRATION CLAUSE AND WAIVER OF CLASS ACTION RIGHTS.

By entering the premises, accessing any Straight Gas platform, or purchasing any product, you affirmatively agree to all terms below.


1. ELIGIBILITY, AGE VERIFICATION & ACCESS CONTROL

All products are intended solely for individuals 21 years of age or older.

Valid government-issued identification is required for:

  • All in-store purchases
  • Order pickup
  • Delivery acceptance

Straight Gas reserves the right to refuse or cancel any transaction at its sole discretion for compliance or safety reasons.


2. REGULATORY STATUS & NOTICE OF UNCERTAINTY

Straight Gas operates as a New York State cannabinoid hemp retailer.

Products may contain hemp-derived cannabinoids, including THCa, which may convert to Δ9-THC when heated.

YOU ACKNOWLEDGE:

  • Laws and enforcement priorities in New York are actively evolving
  • Certain product categories (including inhalable or high-potency items) may be subject to heightened regulatory scrutiny or future restriction
  • Straight Gas makes no representation or warranty regarding future legality after purchase


3. MANDATORY CUSTOMER RESPONSIBILITY

By purchasing, you expressly agree that you are solely responsible for:

  • Compliance with all applicable laws
  • Lawful possession, transport, and use
  • Preventing access by minors or unauthorized individuals
  • Use in a safe and controlled manner


4. NO MEDICAL OR HEALTH CLAIMS

Products sold:

  • Are not approved by the U.S. Food and Drug Administration
  • Are not intended to diagnose, treat, cure, or prevent any disease
  • Are sold strictly for lawful adult use where permitted

No statement by employees or materials shall be interpreted as medical advice.


5. HEALTH, SAFETY & IMPAIRMENT WARNINGS

Use of cannabinoid products may result in:

  • Intoxication or impairment
  • Anxiety, dizziness, or adverse reactions
  • Delayed onset of effects

DO NOT:

  • Drive or operate machinery
  • Use while pregnant or nursing
  • Combine with alcohol or medications without medical consultation

KEEP OUT OF REACH OF CHILDREN AND ANIMALS.


6. ASSUMPTION OF RISK

You voluntarily assume all risks associated with use, including:

  • Adverse physical or psychological effects
  • Variability in potency or experience
  • Unintended or stronger-than-expected effects


7. PRODUCT QUALITY, TESTING & LIMITATIONS

Straight Gas sources products from third-party manufacturers and farms.

  • Certificates of Analysis (COAs) may be provided where available
  • COAs apply only to tested batches
  • Agricultural products are inherently variable

NO GUARANTEE is made regarding identical effects, potency, or user experience.


8. LIMITED WARRANTY DISCLAIMER

TO THE MAXIMUM EXTENT PERMITTED BY NEW YORK LAW:

All products are sold “AS IS” and “WITH ALL FAULTS.”

Straight Gas disclaims:

  • Merchantability
  • Fitness for a particular purpose
  • Consistency of effect

Nothing in this section limits rights that cannot be disclaimed under New York law.


9. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW:

Straight Gas shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits or opportunities
  • Misuse or unauthorized redistribution

IF LIABILITY IS LEGALLY REQUIRED, it shall be limited to the amount paid for the product.

THIS LIMITATION DOES NOT APPLY WHERE PROHIBITED BY LAW, including certain personal injury claims.


10. MANDATORY BINDING ARBITRATION & CLASS ACTION WAIVER

PLEASE READ CAREFULLY — THIS AFFECTS YOUR LEGAL RIGHTS

Any dispute, claim, or controversy arising from:

  • Product purchase or use
  • These Terms
  • Any interaction with Straight Gas

Shall be resolved exclusively through binding arbitration administered by the
American Arbitration Association under its Consumer Arbitration Rules.

YOU AGREE:

  • No lawsuits in court (except small claims where permitted)
  • No jury trial
  • No participation in class actions or mass claims

All claims must be brought individually.


11. INDEMNIFICATION

You agree to indemnify and hold harmless Straight Gas from claims arising out of:

  • Your misuse of products
  • Violation of laws
  • Redistribution or resale
  • Breach of these Terms


12. DELIVERY & TRANSFER OF RESPONSIBILITY

For delivery transactions:

  • Identity verification is required at delivery
  • Responsibility transfers upon confirmed delivery

All risk of loss, storage, and use transfers immediately upon receipt.


13. ZERO-TOLERANCE MISUSE POLICY

Products may not be:

  • Provided to minors
  • Resold without proper licensing
  • Used unlawfully

Violation voids all applicable protections and may result in refusal of future service.


14. PRODUCT RECALL & SAFETY NOTICE

Straight Gas reserves the right to:

  • Issue product recalls
  • Refuse continued sale of any item
  • Notify customers of safety concerns where contact information is available

Customers agree to discontinue use of recalled products immediately.


15. GOVERNING LAW & VENUE

These Terms are governed by the laws of the State of New York.

Any permitted court proceedings shall be brought in New York courts only.


16. SEVERABILITY

If any provision is found unenforceable, all remaining provisions remain in full force.


17. AFFIRMATIVE ACCEPTANCE

By completing a transaction, you confirm that:

  • You have read and understood these Terms
  • You voluntarily agree to all provisions
  • You accept the arbitration clause and class action waiver
